The Governor of the Communications and Information Technology Commission, with the powers he holds, and pursuant to what was stated in the Telecommunications Act, its Bylaw and the Ordinance of the Communications and Information Technology Commission, after reviewing what was stated in Chapter Seven of the Telecommunications Act, Chapter Five of the Telecommunications Bylaw and to achieve the objectives stated in the Commission Statutes including to find the suitable climate for effective and fair competition and encourage them in all fields of communications and work to achieve presence of effective and suitable Interconnection for the communications network and the right of the Service Provider to use the communications facilities of the other service providers in the field of communication and pursuant to the Council of Ministers Decision No. (190) dated 23/6/1424H approving licensing for Itihad Itisalat to install and operate mobile network second generation (GSM) technology and third generation by (3G) technology with its all factors and to provide all its services on the Local, National and International level through his own network in accordance with what was stated in his submitted proposal and as detailed in the Decision. Whereas the proposal submitted from him included the necessity of providing the National Roaming Service in the Kingdom in accordance with the network establishment plan approved by the Commission and in accordance with the work benefit requirements,
(Decides the following):
Article One:
- The Saudi Telecommunications Company shall provide the National Roaming Service to the new mobile service provider (Itihad Itisalat Company) upon his request pursuant to fair, suitable and no unjustified discrimination Terms and Conditions as follows
- A. The Saudi Telecommunications Company will allow the new mobile service provider customer (Itihad Itisalat Company) national Roaming on the mobile network (GSM) belonging to the Saudi Telecommunications Company, with the exception of Roaming inside developmental range for cities of Riyadh, Mekkah, Madinah, Jeddah, Dammam, Khobar and Dhahran
- B. The mandate of The Saudi Telecommunications Company to provide the National Roaming Service for Itihad Itisalat Company will end after Four Years as maximum from the date of start of the service provider to provide his services commercially and the Saudi Telecommunications Company may after this period to conclude a commercial agreement based on mutual negotiation with Itihad Itisalat Company for continuation of the National Roaming Service between them provided that obtaining a prior written approval from the Commission
- The Saudi Telecommunications Company will enter in negotiations with Itihad Itisalat Company on Terms and Conditions of the National Roaming including the suitable and justified prices. Negotiations must be completed and prepare its agreement and submit it to the Commission for approval within (60) days from the date of submitting the application by Itihad Itisalat Company to the Saudi Telecommunications Company
Article Two:
The Saudi Telecommunications Company shall act according to this Tariff from the date of this Decision.
Article Three:
The Saudi Telecommunications Company shall publish the approved amendments pursuant to the Terms of Article Forty Eight of the Telecommunications Bylaw.
Article Four:
This Decision shall be communicated to Saudi Telecommunications Company and Itihad Itisalat Company and the concerned parties to act according to it as of the date of its issuance.
