The Governor of the Communications and Information Technology Commission, with the powers he holds, and pursuant to what was stated in the Telecommunications Act, its Bylaw and the Ordinance of the Communications and Information Technology Commission, after reviewing what was stated in Chapter Seven of the Telecommunications Act, and Chapter Five of the Telecommunications Bylaw, to achieve the Commission objectives stated in the Commission statutes within them to find the suitable climate for effective and fair competition and encouraging it in all fields of communications and work to achieve existence of interconnection suitable and effective for the communications network and the right of the Service Providers to use the communications facilities related to the other Service Providers in the field of communications and in accordance with the work benefit requirements.
(Decides the following)
Article One:
- The Saudi Telecommunications Company shall allow the new Data Service Providers to use (Local Loop) belonging to the Company as follows:
- A. Enabling the new Data Service Providers joint usage of Local Loops with the Saudi Telecommunications Company to send (Shared Access) for the purpose of provisioning of (DSL) for them to provide data services for their customers
- B. Enabling the new Data Service Providers to provide Data Services to their customers by reselling (Bit Stream Access) by using Local Loops prepared by the Saudi Telecommunications Company by (DSL)
- The Saudi Telecommunications Company shall enable Licensed other Data service Providers to participate and actual access to any technically possible point aiming to achieve joint usage of Local Loops, in a manner characterized by equity, transparency and no unjustified discrimination until they become able to install the necessary equipments and establish the necessary transmission links to provide Data Services
- The Saudi Telecommunications Company will propose the Special Terms and conditions including the suitable prices their justifications in order to provide the two possibilities for joint usage of the above mentioned Local Loops and the Shared Access for the new Data Service Providers. This proposal shall be submitted during (60) days from the date of issuance of this Decision to the Commission for study. The Commission intends to publish the proposal submitted from the Saudi Telecommunications Company to request public comments on it before issuance of its Decision regarding this matter.
Article Two:
This Decision shall be communicated to the Saudi Telecommunications Company and the concerned parties to act accordingly as of the date of its issuance.
